Nextera vs. HWC ERT Motions

The ERT sent notice that the motions to dismiss HWC appeal have been denied.  A further motions day to discuss HWC motions is planned for Wednesday, May 9, 2012 at 1:00 pm. at 655 Bay St. Toronto.

The motion to dismiss Bill Monture’s appeal has been granted in part allowing Mr. Monture to continue his appeal with respect to grounds alleging serious harm to human health, or serious and irreversible harm to plant life, animal life or the natural environment.

On Friday March 16th, 2012 REA approval was granted to NextEra by the MOE Director to install 59 wind turbines in Haldimand County. The only remaining recourse is to seek legal action within 15 days of the decision. Haldimand Wind Concerns has done so on behalf of the residents of Haldimand County who are opposed to IWT development.

Haldimand Wind Concerns (HWC) has full support of Wind Concerns Ontario (WCO) and HWC has solicited the expertise of Lawyer Eric Gillespie (leading expert challenging IWT development with notable cases in Prince Edward County and Chatham Kent).

To all Haldimand Wind Concern members and every citizen of Haldimand County who stands opposed to the implementation of industrial wind turbines into our lives. As we have stated from the beginning of this fight to regain our way of life and our right to choose a healthy environment, we will challenge any proponent desiring to change forever our rural way of life. We can do that only if funds permit. Alarming as it may seem, the current provincial government repeatedly refuses to hear the truth about their devastating plan. No matter how many times they have been informed by many people of different professions expressing the real facts, they continue to allow wind turbines to be constructed throughout our province. We are now faced with this very challenge of an opponent’s approval. NextEra has been given their approval to proceed. We have retained the legal expertise of Eric Gillespie to file an appeal of this approval and represent our best interests moving forward. Eric and his team will be working for this county’s concerned folks by representing HWC. He will take the best avenue to challenge this proponent in bringing justice into our lives. Norfolk Wind Turbine Victims

Since 2008, Stephana Johnston has been an advocate for the Norfolk victims of wind turbines living just west of Long Point when she started suffering health effects after the turbines started up. The Norfolk Council at that time rezoned that particular area’s agricultural land to industrial to allow the development of 18 turbines which were crammed in within a 3 km radius. 70 people living in the Clear Creek/Cultus/Frogmore wind turbine zone signed a petition in 2009 as testimony to the adverse health effects foisted on them. Since then, Ms. Johnston has presented Norfolk Council with the petition, health updates and two motions requesting mitigation of their serious situation. Last month, Stephana and three Haldimand residents gave deputations to the HN Health and Social Services Advisory Committee requesting that a survey/clinical study of the Norfolk victims be conducted by the local health unit, warning of increased health cases as 200 wind turbines are proposed for Haldimand.

On Feb. 14, 2012, the Haldimand Norfolk Health Board received a report from the HN Health and Social Services Advisory Committee in response to a petition and resolution brought to Norfolk Council asking for mitigation of the Norfolk victims’ health effects and for a study of the victims to be conducted by the HN Health Unit. The Advisory Committee had passed the following motion: that the HN Board of Health advocate to the Renewable Energy Technologies and Health Research Study (RETH) at Waterloo University to complete their research; that the affected residents in Clear Creek/Cultus/Frogmore wind turbine zone be asked to participate in this study and to encourage Health Canada to implement a clinical research project on industrial wind turbines.

Ms. Johnston informed the Health Board that she asked the Research Chair of the Waterloo study, Dr. Sivoththaman, that the adverse health effects of the Norfolk victims be investigated and offered her own house as the Ontario Centre for the Study of Adverse Effects of IWTs but she had no response. She also had personal communication with Professor Bigelow, the chair of the health portion of the study but once again the suggestion was not accepted. It’s very difficult to trust a health study funded by the same government that is promoting wind energy while people are still suffering living surrounded by wind turbines. On a brighter note, Dr. Locke, Haldimand Norfolk’s Chief Medical Officer of Health, acknowledged that there are victims of wind turbines in Norfolk whose situation should be studied in the Waterloo study. 

The Health Board stated that they do not have the resources, the expertise or the money to conduct a health study of these victims despite a Haldimand RN’s offer to arrange for potential qualified researchers to complete the study at an estimated cost of $25,000. The Board passed a motion to concur with the Advisory Committee’s motion but as we read, blades continue to turn and Norfolk’s victims of wind turbines continue to suffer.

Mayor loses patience with wind turbine critic and her response.

An award winning journalist like Monte Sonnenberg should assure equal space to all sides in reporting an event as well as assure accuracy of information. In “Mayor loses patience…” on Thurs., Feb. 16, Mr. Sonnenberg assassinated the character of the deputant by using inflammatory language meant to imply that her statements are untrue. A councillor is quoted as saying people in Simcoe are exasperated with “repetitive presentations” in spite of the fact each presentation ALWAYS brought new information. Norfolk Victims of Industrial Wind Turbines ARE residents of the community and Norfolk County and as such have a right to 10 minutes of courtesy and justice as is afforded to deputations dealing with culverts week after week.

It also behooves an award winning journalist to present accurate information: There are 38 IWTs in the Norfolk Erie Shores Wind Farm as well as the 18 IWTs of the Clear Creek/Cultus/Frogmore IWT zone which 70 residents in the 140 house community DECLARE are adversely affecting their lives and health. Travale’s explanation “that Norfolk Council has done all it can for her” does NOT address the fact that infrasound from IWTs disturbs sleep night after night and leads to health hazards and increased mortality according to a research paper from professor Alec Salt, Otolaringologist at the Washington University School of Medicine in St. Louis, Missouri.

Haldimand-Norfolk Board of Health passes resolution re IWTs

Thanks to Stephana Johnson’s tireless work, Haldimand-Norfolk Board of Health passed the following resolution on February 14, 2012:

“THAT the Board of Health advocate to the Renewable Energy Technologies and Health (RETH) Research Study at the University of Waterloo to complete their research and encourage Health Canada to implement a clinical research project on Industrial Wind Turbines;

AND THAT the affected residents from the Clear Creek/Cultus/Frogmore Industrial Wind Turbine zone be asked to be included in the RETH project;

AND FURTHER THAT the contact information of the RETH project be forwarded to the four deputations that appeared at the Health & Social Services Advisory Committee.”
